Under this law, drivers also cannot listen to music through earbuds or headphones.  Georgia’s Hands-Free Georgia Act has been in effect since July 2018, and citations will be issued for law violations. O.C.G.A. § 40-6-241. 

What is interesting to note is that five years after Georgia’s “hands-free” cell phone restrictions for drivers took effect, the latest numbers show that fatal traffic crashes across the state caused by distracted drivers are less than before the law took effect.

  • Avoid Eating and Drinking: Eating or drinking while driving can significantly distract. It is better to take a break and eat before continuing your travels rather than trying to manage food and drinks on the road.
  • Secure Pets Properly: Pets can be unpredictable and distracting if not secured. Use pet carriers or seat belts designed for pets to keep them safe and prevent them from causing distractions.
  • Educate Young Drivers: Young drivers are particularly at risk for distracted driving. Educate them about the dangers and ensure they understand the importance of focusing solely on driving.
  • Set a Good Example: Lead by example. Your friends and family will likely follow suit if you practice safe driving habits. Avoid using your phone or engaging in other distracting behaviors while driving.
  • Use Safe Driving Apps: Some apps can help minimize or eliminate the use of smartphones while driving. These apps can block incoming calls and texts or send automatic replies to let others know you are driving.
  • Take Breaks on Long Trips: If you drive long distances, schedule breaks to rest, check your messages, make calls, or use social media. It is safer to complete these tasks while parked.
